Rental Housing Concentration Cap

The City Council meeting starts at 6 p.m. this Tuesday. The agenda includes (but is not limited to):
The two big topics this week are the rental cap and the Downtown Gateway zoning. They are both topics Council has visited multiple times over the past several months, and have dedicated much time to (rightly so, as they are both difficult topics with many short and long-term impacts).

35. Rental Housing Concentration Cap:
a. Discussion of hardship options.
Staff present 3 basic options. Option 1 requires a 2-year attempt to sell a property, and requires abutting rental properties in order to qualify. Option 2 requires a 9-month market listing, with no abutting properties required. Option 3 allows 6 months for anyone who currently owns property to apply for a rental permit.
b. Third passage and adoption of ORDINANCE NO. 4354 setting the rental concentration cap.
This is the 3rd passage of an ordinance that would set a 25% rental cap for designated neighborhoods.
c. Resolution establishing Concentration Cap boundaries.
This will establish the neighborhoods for which we are setting a rental cap. Currently proposed are SCAN (North), Colonial Village, Oak-to-Riverside, Oakwood Forest, College Creek Old Ames Middle School, and Old Edwards.
d. First passage of ordinance revising Chapter 13, Rental Housing Code, to continue Moratorium until July 31, 2018, (Second and third readings and adoption requested), if needed .
This would extend the moratorium on new rentals, in case we haven't finalized details on hardships and the cap ordinance itself before the current moratorium is set to expire. - 37. Second passage of Downtown/Gateway Zoning District Ordinance pertaining to standards.
This is the second passage of an ordinance that would create a new zoning district, called the Downtown Gateway. It is different from the current HOC in that it doesn't allow some of the current uses we see in the area (Vehicle service, storage units, etc.), while also allowing for some residential uses. -
42. Hearing on rezoning properties within the Downtown Gateway Focus Area of the Lincoln Way Corridor Plan from Highway Oriented Commercial (HOC) and Downtown Service Center (DSC) Zoning Districts to Downtown Gateway Commercial Zoning District and first passage of ordinance.
The Downtown Gateway zoning district is merely a concept before we actually apply it to properties. This agenda item involves the actual designation of properties to this new zoning district. The current proposal is referenced below in this map:
