108 Acre Annexation, Corporate/City Agreements with Burke, Barilla, and John Deere
The City Council meeting starts at 6 p.m. this Tuesday. The agenda includes (but is not limited to):

17. Motion approving the concept of accepting hauled waste from Burke Corporation and directing staff to develop a written Treatment Agreement.
The Burke Corporation, in Nevada, is looking to send some of their waste water through our facility. Staff have detailed the increased load from Burke, and report that capacity is available, at least until Nevada can expand their facility (approx 4 years). This relates to the Eastern Industrial land and how it gets utilized, as any capacity we give up now won't be available for new users. (Or we have to build a bigger/better facility sooner than we plan to, which takes money generated by user fees.) At least for now, staff are recommending that the Burke load won't tax our capacity. -
18. Staff Report regarding request by Barilla to allow for missing infrastructure deferral.
In this case, Barilla is asking to have occupancy of their expanded facility BEFORE the construction of a required sidewalk along Lincoln Way, east of Hwy 35. They argue they have other work to do, and would need to tear up and reinstall the sidewalk very soon anyway, and on the staff side, Public Works in not yet sure if they would prefer the sidewalk on the north or south side of Lincoln Way. Thus, staff are suggesting a change to the code that would allow some flexibility on the timing of the installation. In either case, financing for the sidewalk would be secured from Barilla. -
19. Motion initiating the annexation request by Friedrich for 108 acres lying west of George Washington Carver Avenue and south of Cameron School Road.
Staff are recommending that we annex only the Friedrich property, and not pursue the 80/20 method of annexation, which allows for 20% non-consenting land to be brought in with 80% consenting. Before annexation of this 108 acres, the developer will be required to complete a traffic study and development agreement.

20. South Grand Avenue Extension Project.
This item deals with the acquisition of 15.4 acres of land for $239,000 just south of South 5th and Walnut. This land will be used for the extension of South 5th St., which is a component of the South Grand Ave. extension. The land will also be used for roadway material, and then turned into a stormwater wetland. -
21. Hearing on Lease Agreement with Deere & Company for approximately 53.03 acres of City land located along S. Riverside Drive, directly west of the Ames Municipal Airport.
John Deere is building a "Spray Lab" at the Research Park to develop and test new spraying equipment and software. This lease agreement allows Deere & Co. to use 53 acres of land near the airport for test spraying, though the agreement does stipulate that they can spray only water while testing.
